1. Introduction & Data Controller

This Privacy Policy describes how your personal information is collected, used, and shared when you interact with Summie Jewelry LLC. It applies to information we collect through summiejewelry.com (the "Site"), and equally to information you provide to us in person — at our retail store, at appointments, at private parties, pop-ups and events, over the phone, by text message, or through any other channel where you share your information directly with us (together, the "Services").

The Data Controller for the Services is Summie Jewelry LLC, a Florida Limited Liability Company (Registration #L23000178250), doing business as Summie Permanent Jewelry Naples FL ("we," "us," or "our").

2. Personal Information We Collect

Information collected automatically on the Site. When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.

Information you provide on the Site. When you book an appointment or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, payment information (including credit card numbers), email address, and phone number.

Information you provide in person or offline. When you visit our retail store, book or attend an appointment, attend an event or private party, redeem an offer or coupon, join our loyalty program, or sign up for email or text updates, we may collect your name, email address, phone number, mailing or billing address, purchase and appointment history, loyalty activity, and payment information. This information is collected and stored through our point-of-sale, booking, and customer relationship platforms, including Square and GoHighLevel.

Throughout this Policy, all of the above is referred to together as your "Personal Information."

3. How We Use Your Personal Information

We use the information that we collect generally to fulfill any orders, appointments, or services you request (including processing your payment information, arranging for service appointments, and providing you with invoices and/or order confirmations). Additionally, we use this information to:

  • Communicate with you, including by email and text message where you have opted in;
  • Operate our loyalty program and honor offers, coupons, and promotions;
  • Screen our orders for potential risk or fraud;
  • Understand and improve our Services, and measure the performance of our marketing; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our permanent jewelry products and services.

4. Authorized Data Processing for Advertising

Digital operations, marketing, and the management of advertising data (including Google Ads tracking and Meta advertising) are overseen by Marcio Naegele, Director of Operations. Marcio Naegele is a formally authorized representative of Summie Jewelry LLC and acts as the point of contact for all data privacy and advertising compliance matters.

5. Sharing Your Personal Information

We share your Personal Information with third parties who perform services on our behalf, so that they may help us operate our business and provide the Services to you. These service providers include our point-of-sale and booking platforms, our customer relationship and messaging platforms, our website host, our payment processors, and our analytics and advertising partners.

Advertising partners and customer lists. We share Personal Information — including your email address, phone number, and name — with advertising platforms, including Google (Google Ads and Google Analytics) and Meta (Facebook and Instagram), so that they may perform advertising services on our behalf. This includes uploading customer lists so that these platforms can match your information against their own users in order to show you relevant advertising, to measure the performance of our advertising, to build audiences of people with similar characteristics, and to exclude existing customers from campaigns intended to reach new customers. Where these platforms support it, your information is cryptographically hashed before it is transmitted. We do not sell your Personal Information.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

6. Behavioral Advertising & Your Choices

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We use cookies and similar tracking technologies to store and/or access information. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.

You may also ask us directly to remove your information from the customer lists we share with advertising partners, to unsubscribe from marketing emails (using the unsubscribe link in any email), or to stop marketing text messages (by replying STOP). Contact details are in Section 11.

7. Data Security

We implement a variety of security measures to maintain the safety of your personal information. All sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers' database only to be accessible by those authorized with special access rights to such systems.

8. Data Retention

We retain your Personal Information for as long as it is needed to provide the Services, maintain your customer and appointment history, honor loyalty benefits, and comply with our legal and accounting obligations. Customer lists shared with advertising platforms are refreshed periodically, and information that is no longer current is removed. You may request deletion of your information at any time using the contact details in Section 11, subject to any records we are required to keep by law.

9. Children's Privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from anyone under 13. We do not include information about individuals under 13 in any customer list shared with advertising partners. Where a minor receives our services, we collect the information of the accompanying parent or guardian. If you believe we have collected information from a child under 13, please contact us and we will delete it.

10. Your Rights & Choices

Regardless of where you live, you may contact us to request access to the Personal Information we hold about you, to ask that we correct or delete it, or to opt out of marketing communications and of having your information included in the customer lists we share with advertising partners. We will respond to your request within a reasonable period.

Depending on your state of residence, you may also have specific statutory rights — including under the Florida Digital Bill of Rights and comparable laws in other states — to access, correct, delete, or obtain a copy of your Personal Information, and to opt out of its use for targeted advertising. We honor these requests from all of our customers as a matter of practice, whether or not a particular law applies to us. We will not discriminate against you for exercising any of these rights.
